OVERVIEW
Welcome to the Seattle Science Foundation (“SSF”). The terms “we,” “us,” and “our” refer to Seattle Science Foundation, a nonprofit organization. SSF operates this online merchandise store and website, including all related information, content, features, tools, products, and services (collectively, the “Services”) to support our educational and charitable mission.
Seattle Science Foundation is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with any policies referenced herein (including our Refund Policy and Privacy Policy), govern your access to and use of the Services and describe your legal rights and responsibilities.
By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, you should not access or use the Services.
SECTION 1 – ACCESS AND ACCOUNT
By using the Services, you represent that you are at least the age of majority in your state or province of residence, or that you have the consent of a parent or legal guardian.
To use certain features of the Services or make a purchase, you may be required to provide information including your name, email address, billing details, payment information, and shipping address. You represent and warrant that all information you provide is accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You may not sell, transfer, or assign your account to another person.
SECTION 2 – OUR PRODUCTS
All merchandise sold through the Services is offered in support of Seattle Science Foundation’s nonprofit mission.
We make reasonable efforts to display product descriptions and images accurately. However, product colors, materials, or appearance may vary due to device settings or manufacturing differences. We do not guarantee that product appearance will exactly match what is displayed on your screen.
Product descriptions, availability, and pricing are subject to change without notice. We reserve the right to discontinue or limit the quantity of any product at any time.
SECTION 3 – ORDERS
By placing an order, you are making an offer to purchase merchandise from Seattle Science Foundation. We reserve the right to accept or decline any order at our discretion. An order is not accepted until payment has been processed and confirmation has been sent.
Please review your order carefully before submitting. Due to limited staff capacity, we may be unable to accommodate order changes or cancellations once an order has been accepted.
All purchases are subject to our Refund Policy [LINK], which provides that all sales are final, except as required by law or in cases of damaged or incorrect items.
You represent that all purchases are for personal or household use and not for resale or commercial purposes.
SECTION 4 – PRICES AND BILLING
Prices are subject to change without notice. The price charged will be the price displayed at checkout at the time the order is placed. Prices do not include applicable taxes, shipping, handling, customs, or import fees unless stated otherwise.
You agree to provide accurate and complete payment information and authorize us to charge your selected payment method for all applicable charges. You are responsible for all charges incurred under your account.
SECTION 5 – SHIPPING AND DELIVERY
Shipping and delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events beyond our control.
Title and risk of loss pass to you once the order is transferred to the carrier.
SECTION 6 – INTELLECTUAL PROPERTY
All content included in the Services—including text, images, logos, graphics, videos, designs, and trademarks—is owned by or licensed to Seattle Science Foundation and is protected by applicable intellectual property laws.
You may use the Services only for personal, non-commercial purposes. You may not reproduce, distribute, modify, or otherwise exploit any content without prior written permission from Seattle Science Foundation.
Seattle Science Foundation’s name, logos, and branding are trademarks of Seattle Science Foundation. Shopify’s trademarks belong to Shopify Inc. All other trademarks belong to their respective owners.
SECTION 7 – OPTIONAL TOOLS
We may provide access to third-party tools or services that we do not control. These tools are provided “as is” and “as available,” without warranties or endorsements. Use of optional tools is at your own risk.
SECTION 8 – THIRD-PARTY LINKS
The Services may include links to third-party websites. We are not responsible for the content, accuracy, or practices of third-party sites. Accessing third-party websites is at your own risk.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Seattle Science Foundation is powered by Shopify. However, all purchases are made directly with Seattle Science Foundation. Shopify is not responsible for any aspect of transactions between you and Seattle Science Foundation, and you expressly release Shopify from any related claims.
SECTION 10 – PRIVACY POLICY
Your use of the Services is subject to our Privacy Policy [LINK] and Shopify’s Privacy Policy. By using the Services, you acknowledge and agree to the collection and use of your information as described in those policies.
SECTION 11 – FEEDBACK
Any feedback, reviews, or suggestions you submit may be used by Seattle Science Foundation without compensation, restriction, or obligation, in accordance with applicable law.
SECTION 12 – ERRORS AND OMISSIONS
We reserve the right to correct errors, inaccuracies, or omissions and to cancel or modify orders if any information is inaccurate at any time, including after an order has been submitted.
SECTION 13 – PROHIBITED USES
You may use the Services only for lawful purposes. Prohibited conduct includes misuse of content, harassment, fraud, interference with site security, or violation of applicable laws.

We may suspend or terminate your access to the Services at any time without notice if you violate these Terms. Obligations incurred prior to termination will survive.

SECTION 16 – LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, SEATTLE SCIENCE FOUNDATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS.
SECTION 17 – INDEMNIFICATION
You agree to indemnify and hold harmless Seattle Science Foundation and Shopify from claims arising out of your violation of these Terms or misuse of the Services.
SECTION 18 – SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
SECTION 19 – ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and Seattle Science Foundation regarding use of the Services.
SECTION 20 – ASSIGNMENT
You may not assign these Terms without our written consent. We may assign these Terms without restriction.
SECTION 21 – GOVERNING LAW
These Terms are governed by the laws of the state in which Seattle Science Foundation is headquartered, without regard to conflict-of-law principles.
SECTION 22 – HEADINGS
Headings are for convenience only and do not affect interpretation.
SECTION 23 – CHANGES TO TERMS
We may update these Terms at any time by posting changes on this page. Continued use of the Services constitutes acceptance of the updated Terms.
